INSURANCE AND COMPLIANCE

  • Preparing EXCO and Board reports regarding compliance implementation and monitoring;

  • Ensure compliance with Financial Intelligence Center Act(FICA);
  • Ensure that the relevant managers understand the implications and comply with the Financial Advisory and Intermediaries Act (FAIS) and Financial Intelligence Centre Act (FICA);
  • Assist with editing of training manuals to ensure compliance with product specifications and legislation;
  • Draft agreements i.e broker agreement, investment management agreement, administration agreement, services and service levels agreement
  • Draft life insurance policy document i.e credit life policy, group scheme policies, and funeral policies.
  • Liaise with external attorney regarding litigation matters and trademark registration;
  • Assist with product development,
  • Contract negotiations with regard to sale of funds and joint venture agreements;

Employee benefit and Pension law

  • Giving instructions to defend court applications;
  • liaising with the state attorney and counsel to ensure that instructions are carried out
  • drafting of court documents
  • legal advice and opinions
  • Drafting of responses to Adjudicator Complaints;
  • Liaise with the Pension Funds Adjudicator
  • Attend Conciliation, pre-conciliations at the Adjudicator’s Office;
  • Manage the Adjudicator Complaints and allocate complaints to legal advisers; and
  • Check the Adjudicator Responses before they are sent to the adjudicator.

Responses to queries from consultants

  • Queries relating to the Pension Funds Act, the rules, the regulations, circulars and directives.
  • Queries relating to the Income tax Act and General Notices
  • General queries relating to other legislation such as the Divorce Act, Labour Relations Act, Long-term insurance Act, FAIS and FICA.

Publications

  • Contributing to publications such as Pensions World and quarterly.
  • Update business on recent legal development with internal publications.
